OHS Harmonisation in 2012

On the 1st January 2012 OHS laws will undergo significant change including:
  • A new set of safety obligations as an "officer' of a company
  • Due diligence
  • Expanded responsibilities for the health and safety of all employees and workers - staff, contractors, labour hire
  • Consultation
  • Discriminatory conduct
  • Union right of entry requirements
  • Emeregency management

Changes that will affect the construction industry in particular are :

  • Design risk management
  • Permits for excavation fro the regulatory authority
  • Plant operator competencies
  • WHS (Workplace Health & Safety) Plans prior to the start of work

Changes to workplace health & safety laws will affect each State slighly differently. Based on a survey carried out for the Consultation Regulatory Impact Statement, changes will affect the various Australian states as follows:
